PFDC supports Fair Data Bill PDF Print E-mail

The bill, which amends the Regulatory Review Act, was introduced last year but did not go anywhere.  It has passed the PA State Senate unanimously this session, but it may face a tougher battle in the PA House of Representatives.

The bill adds the following definition to the act: " Acceptable data . " Empirical, replicable and testable data as evidenced in supporting documentation, statistics, reports, studies or research.
It then requires that the regulatory analysis form submitted with the regulation include "(14) A description of any data upon which a regulation is based with a detailed explanation of how the data was obtained and why the data is acceptable data. An agency advocating that any data is acceptable data shall have the burden of proving that the data is acceptable. "

It further requires the IRRC to consider the whether the regulation is in the public interest, including: ''The protection of the public health, safety and welfare and the effect on this Commonwealth' s natural resources. The data used as the basis of a regulation is acceptable data. "  It also requires  that "The data used as the basis of a regulation is acceptable data " and "Whether acceptable data is the basis of the regulation ."
